Tiny to crack down on noise over the next two weeks

New definitions have been included to improve clarity in the interpretation of the by-law and prohibited time period

The Township of Tiny is launching a Noise Enforcement Campaign in an effort to increase awareness of local Municipal Law Enforcement initiatives.

The Noise Enforcement Campaign will run from June 28 to July 5, 2021. This campaign is intended to promote public awareness of the Noise Control By-law #21-028 passed on April 28, 2021 and the rules relating to noise in the Township of Tiny.

The objectives of the campaign are to:

  • Promote awareness of the Noise Control By-law #21-028;
  • Increase education and enforcement of the specific rules;
  • Promote awareness of the By-law Department coverage.

Noise Control By-law #21-028, Section 3.1 states: “No person shall emit or cause or permit the emission of noise resulting from activity listed in Schedule “A” if clearly audible at a point of reception.” The following are two examples of complaints commonly reported to the municipality:

  • The operation of any electronic device or group of connected electronic devices incorporating one or more loudspeakers or other electromechanical transducers, and intended for the production, reproduction or amplification of sound;
  • Persistent barking, calling, or whining or other similar persistent noise made by any domestic pet or any other animal kept or used for any purpose other than agriculture;

New definitions to improve clarity and consistency in the interpretation of the by-law and prohibited period of time are as follows:

Domestic Tool: means any tool, equipment or device designed or intended for use for construction or maintenance of private property by the private property owner where a building permit is not required including, but not limited to - air compressors, electric power tools, manual hammers, and similar tools, but does not include Lawn Maintenance Equipment, or equipment used for the removal of snow.

Lawn Maintenance Equipment: means any equipment, which uses a combustion or electric motor for the purposes of yard maintenance or repair and includes chain saws, lawn mowers, leaf blowers, grass trimmers, or any other similar equipment, but does not include equipment used to remove snow or ice.

Increased noise set fines, doubled from $150 to $300 and established a second fine of $500. Where a person is charged and must attend court, fines may be up to $100,000 at the court’s discretion.

Sunday to Thursday (9 a.m. to 11 p.m.)
Friday & Saturday (9 a.m. to 3 a.m.)

If you have a noise concern, consider speaking with those responsible for making the noise to give them an opportunity to correct the issue. If you are a tenant, please speak to your landlord first and give them a reasonable period of time to correct the issue.
